This agreement covers the closed test of the Talking Pixels website and the Talking Pixels Game Launcher. By checking the box on the application form or using an invite key, you agree to it. Please read it. It's short, and I've kept it plain. ## 1. Who can join You need to be at least 18, or the age of majority where you live, to take part. You apply through talkingpixels.games/testinvite. I review every application by hand, and I can say no without giving a reason. I'm keeping the group small so I can actually listen. ## 2. What the test is This is pre-release software. Things will break. Features may change, move or disappear, and test data, including accounts, games, posts, saves and progress, may be reset or deleted while I fix things. I'll try to warn you before a reset, but I can't promise it. Please keep your own copies of anything you care about, especially your game files. Launcher test builds may not be code-signed yet, so Windows may show a warning when you install them. Only install builds you downloaded from talkingpixels.games or through the launcher itself. ## 3. What I ask of you - Try things, and tell me when something breaks or feels wrong, using the built-in bug report and feedback tools where you can. - Answer the occasional short survey if you have time. Spend as much or as little time as you like. - Be kind to other testers. The community rules on the site apply here too, and I can remove anyone who harasses others, cheats, abuses bugs to harm other people, or tries to break into things they shouldn't. ## 4. Invite keys Your invite key is for you. Please don't sell, share or post it. If a key is shared, I may disable it and the accounts it created. ## 5. Sharing what you see You're welcome to talk about the closed test and share your own screenshots and clips. Please mark them "closed test" so people know it isn't finished. Please don't share: - other creators' unpublished games, pages or files, - anything marked private or confidential, - other testers' personal information. ## 6. Your feedback Bug reports, ideas and suggestions you send me can be used to improve Talking Pixels without paying you or crediting you. If you'd like to be credited, tell me and I'll gladly add your name to the closed-test credits. ## 7. Your games and content stay yours Anything you upload, such as games, art, devlogs and pages, remains yours. You give me permission to host it, display it, make copies needed to run the service (like backups and thumbnails), and show it to players on the website and in the launcher, for as long as you keep it on Talking Pixels. If you're a creator, you also give me permission to feature your game, your studio and your team in Talking Pixels marketing, such as the homepage, the launcher, the magazine, Showcases, social posts and trailers, using your game's name, public page content and media. You can opt out of featuring at any time from your dashboard or by contacting me, and I'll stop using your content in new marketing. You confirm you have the rights to everything you upload. ## 8. Money during the test Some features, like buying games, backing Sparks and creator payouts, may use real money during the test. When they do, the normal fees on the Fees page and the normal Terms of Service apply, and refunds follow the refund policy. Taxes on your sales are your responsibility. ## 9. Privacy I use your application and test activity to run the test, fix problems and contact you about it. The Privacy page explains what I collect, how long I keep it and how to ask me to delete it. ## 10. Leaving You can stop testing at any time. I can end the closed test, or your place in it, at any time. Sections 6, 7 (for content already featured), 10 and 11 still apply after you leave. ## 11. The legal part The closed test is provided "as is", without warranties of any kind. To the extent the law allows, Talking Pixels Studios LLC isn't liable for lost data, lost profits or indirect damages from taking part, and its total liability to you for the closed test is limited to the greater of what you paid it during the test or $50. Nothing here limits rights you have under laws that can't be waived. This agreement is governed by the laws of the State of Arizona, USA. If part of it is found unenforceable, the rest still applies. I may update it during the test; I'll post the date at the top, and if changes are significant I'll let testers know before they take effect. ## 12.
